East Kent Jag II
Lenziejag, from the CoS decision by Lord Clark, DU etc made two applications. First was to reject the Thistle/ Hearts Petition, which was rejected by Lord Clark. But the second, from what I can see, was to cist (pause) the Petition, to allow arbitration. Arbitration is a separate process to the CoS case, as they have joined themselves to this. I like the Belgian case. Belgian FA rules etc may be different from SPFL rules, but it was from a Court of Arbitration, may now end up in The Court of Arbitration in Lausanne, if appealed by the Belgian authorities. I believe that this decision will put pressure on the SPFL, but as has been pointed out many times, they don't have any casino chips to play with. I also know that judiciary everywhere hate to have their cases referred to a higher court. They do not want to be overruled, or found to have erred in law. Doesn't do their career prospects any good. I'm more optimistic now that there will be some positive outcome at the end of the road.

Jaggernaut
A good article. I'd have liked it to emphasize that we were just one point behind the next team with a home game in hand; we weren't even given the same opportunity to earn the same "points per game" score as other teams. I understood from comments on this thread that all that can be argued at the arbitration is what was in the petition to the court ? Those 3 clubs petition was dismissed. The substance of their case wasn't rejected by the court. A motion to dismiss the case was rejected. Completely different.
allyo
Is it just me or is DU, RR, and Cove trying to line all the other clubs against us not a really bad look? Many of them voted to eliminate relegation and obviously recognise the unfairness of our own plight. Edited July 9, 2020 by allyo

Maybe Hearts, Stranraer and us should ask for them to support us against those three? Reversing the promotions and relegations won't cost the league any money so it comes down to which three clubs deserve to be out of pocket by an unfair ending of the season. The clubs refused to take the way out which would have prevented any clubs from major disadvantage so maybe they should be asked to get off the fence! As one poster reminded us, everyone got 50k to use as needed so not as if they haven't had extra money from expectations. I wonder if the spfl have done anything to facilitate this. If so, it would certainly be against their rules if they are assisting clubs to gang up against 2 members. DU really must want to sign Nisbet from Dunfermline given how much their begging bowl has been out recently. What next Lorraine Kelly highlighting their ‘plight’ on gmtv? So you are saying it is OK for the SPFL to actively assist (if that is what they have done) in fundraising for 3 clubs to take legal action against 2 others who they are not helping in the same way ? I'm not sure what the legal definition of "duty of care for all members" is, but it is bollocks if that is allowed

javeajag
sounds like fun in Belgium..... The crisis meeting in Belgium is over (held in the wake of the BAS ruling), and a new general assembly will be held in two weeks. Now the "fun" part comes. They want to vote to "confirm" the decisions of the 15th of May and continue with what they planned. If they just decide the same thing (perhaps with more explanation, they claim they have a "strong case"), more legal proceedings can be expected. Note that one week later the game for promotion will take place and the weeks after that the new season starts.

gianlucatoni
Falkirk telling the methadone 3 to sling their hook ... A number of supporters have contacted the club in connection to an article published by the BBC today. Falkirk Football Club wish to reassure supporters that we have not received an approach from representatives of Dundee United, Raith Rovers or Cove Rangers asking for financial support for their legal costs. If such a request is received, it will be refused immediately. Edited July 9, 2020 by gianlucatoni
